These Terms of Use are valid for any information, texts, images and other materials, that is, any content that is uploaded, downloaded or linked to the Services offered by AGE.
ACCEPTANCE OF THESE TERMS OF USE IS INDISPENSABLE TO THE USE OF THE SERVICES OFFERED BY MEUSOC. ALL USERS MUST READ THESE TERMS OF USE, UNDERSTAND THEM AND ACCEPT THEM; AFTER ALL, THE USE OF THE SITE AND THE APPLICATION IMPLIES FULL ACCEPTANCE OF THESE TERMS OF USE. IF YOU DO NOT AGREE WITH ANY PROVISION HEREIN, DO NOT USE THE APPLICATION OR CONTRACT THE SERVICES.
Access to and use of MeuSOC are directed exclusively (i) to users over 18 (eighteen) years of age, resident and domiciled in Brazil, who have full legal capacity for its use; and (ii) to companies in good standing, legally constituted and existing in accordance with the applicable legislation (the "Users"); (iii) companies whose line of business is related to the provision of occupational services. If AGE detects any account created from false information or by irregular or non-existent companies, that account will be automatically deleted and these Terms of Use will be automatically terminated.
1. Object and Purpose of the Terms
These Terms of Use govern the access and use of the MeuSOC application, developed and maintained by AGE Desenvolvimento de Sistemas Ltda., establishing the legal conditions that govern the relationship between the company and the users of the platform. This application can be installed on the device, if the device allows and provided it is downloaded by the user through an online store, such as Google Play or Apple Store. By creating an account, accessing or using the application, the user expresses full agreement with all the provisions set forth herein and declares to be aware that the use of the system is conditioned on the strict observance of these Terms. If you do not agree with any clause, we recommend that you refrain from using MeuSOC.
2. Nature and Purpose of the Platform
MeuSOC is a tool intended for the management of information, processes and flows related to Occupational Health and Safety (OHS). The system enables features such as the registration of personal information, the monitoring of corporate processes, the submission of documents, the recording of evidence and the conduct of video calls linked to the activities performed by AGE's client companies.
The user declares to understand that the proper use of the platform depends on the veracity of the information provided and the adoption of conduct compatible with the institutional purpose of the system.
3. Access to the System and Responsibility for Credentials
Access to the application requires the creation of an individual account composed of authentication credentials, the confidentiality of which is the sole responsibility of the user. The user undertakes not to share their password, to adopt security practices on their devices and to immediately report any suspicion of misuse or unauthorized access. AGE is not responsible for damages arising from the user's negligence, malpractice or imprudence in managing their credentials.
4. User Conduct and Permitted Use
During the use of the application, the user undertakes to provide only true, complete and up-to-date information, assuming full civil, administrative and criminal liability for the statements made and the documents submitted.
The use of MeuSOC for illicit, fraudulent, offensive, defamatory purposes or those incompatible with current legislation is expressly prohibited. Any attempt at reverse engineering, intrusion, unauthorized modification, exploitation of flaws, violation of copyright or interference with the regular operation of the platform also constitutes misuse.
The User is responsible for:
Any damage caused by the User to AGE or to third parties due to non-compliance with the obligations set forth herein or the untruthfulness of the warranties declared herein shall be repaired exclusively by the User who caused the damage, with no subsidiary liability of the obligation, nor joint liability of AGE.
You are expressly prohibited from acting in a way (or helping third parties to), directly or indirectly, through automated or other means, to access, use, copy, adapt, modify, prepare related derivative works, distribute, license, sublicense, transfer, display, perform or otherwise exploit our Services in unauthorized or prohibited ways, as well as in ways that burden or harm us and our Services, systems, our users or third parties. For this reason, you must not, through automated means or directly: a) reverse engineer, alter, modify, create derivative works, decompile or extract code from our Services; b) send, store or transmit viruses or other harmful computer code through or to our Services; c) obtain or attempt to obtain unauthorized access to our Services or systems; d) interfere with or disrupt the security, protection, confidentiality, integrity, availability or performance of our Services; e) create accounts for our Services through automated or unauthorized means; f) collect information from or about our users in an unauthorized or prohibited manner; g) sell, resell, rent or charge for the use of our Services or for the data obtained through us or our Services in an unauthorized manner; h) distribute or make our Services available on a network where they can be used by multiple devices at the same time, except as authorized through tools that we expressly provide through our Services; i) create software or APIs that work essentially in the same way as our Services and make them available for use by third parties in an unauthorized manner; or j) misuse any reporting channels, for example, by submitting fraudulent or unfounded reports or appeals.
You are responsible for keeping your device and your MeuSOC account secure against third-party acts and for notifying us immediately of any unauthorized use or security breach in your account or in our Services.
5. Updates, Maintenance and Changes to Features
AGE may, at any time and for reasons of security, maintenance, improvement or legal requirements, update, modify, suspend or discontinue features of the application. The company will always seek to maintain the minimum continuity of essential services, without this characterizing liability for indemnification, except in the event of contractual breach. Scheduled interruptions will be communicated through available means, whenever technically possible.
6. Data Protection
The Parties undertake to strive to comply with the data protection laws applicable to their business, including, but not limited to, the General Personal Data Protection Law - LGPD. They also undertake to respect online privacy and the need to protect and manage any personally identifiable information ("Personal Data") to which they may have access.
The Parties declare that they will maintain sufficient security, technical and administrative measures to protect the Data Subject's personal data and to inform the National Data Protection Authority (ANPD), and shall, whenever possible, jointly notify the Data Subject if any security incident occurs that may pose a risk or relevant damage, pursuant to article 48 of Law no. 13,709/2018.
The user declares to be aware that certain features depend on the processing of registration, operational and, in some cases, sensitive data related to OHS activities. Continued use of the platform presupposes agreement with such processing, which is essential to the purpose of the service.
The user declares awareness regarding the storage of their personal data voluntarily provided at the time of registration on the MeuSOC Application, which will remain stored for as long as use continues, for the purpose of performing the services; however, the data will be kept if it is necessary for the eventual fulfillment of a legal or regulatory obligation, or also for the offering of new services and prospecting by AGE.
AGE undertakes to implement appropriate technical and organizational measures to protect personal data, ensuring the security, confidentiality and integrity of the information processed.
7. Intellectual Property
Subject to these Terms of Use, AGE grants the User limited, non-exclusive and non-transferable access to use MeuSOC only insofar as is strictly necessary for the fulfillment of the obligations and enjoyment of the rights set forth in these Terms of Use.
All rights relating to MeuSOC, as well as its features, are owned by AGE, including with respect to all intellectual property rights related to its texts, images, graphics, trademarks, layouts, codes, databases and other content produced directly or indirectly by AGE ("Intellectual Property Rights"). The improper use of any content or trademarks presented on MeuSOC is expressly prohibited.
Intellectual Property Rights are protected by copyright and industrial property laws. It is prohibited to use, copy, reproduce, modify, translate, publish, transmit, distribute, perform, upload, display, license, sell or exploit the Intellectual Property Rights for any purpose. No copying, distribution, reverse engineering, or display of the Application, the Site and/or the Intellectual Property Rights shall be understood as a restriction or waiver of AGE's intellectual property rights.
Any use of the Intellectual Property Rights may only be made with the prior and express authorization of AGE. The User assumes any and all liability, of a civil and/or criminal nature, for the improper and unauthorized use of the Intellectual Property Rights. Any suggestion, request for improvements, recommendations or other ideas provided by the User to AGE, related to the operation of the Application, shall not grant the User any ownership right over the features eventually implemented by AGE, so that the User shall not have any right of retention, use or indemnification.
8. Account Deletion and Effects of Removal
The user may request the deletion of their account at any time, as provided for in the Privacy Policy, respecting the legal hypotheses for data retention. Deletion implies the termination of access and features, and it is not possible to recover any content or documents subsequently.
9. Limitations of AGE's Liability
AGE is not responsible for unavailability resulting from factors beyond its control, such as connection failures, interruptions of third-party services, unavailability of external servers, network fluctuations, fortuitous events or force majeure. Likewise, it is not responsible for losses resulting from incorrect information provided by the user or by third parties.
10. Changes to the Terms of Use
These Terms may be changed whenever necessary, especially due to regulatory changes, technological developments or operational improvements. The changes will be made available in the application and will take effect immediately after their publication. Continued use of the platform after the disclosure of a new version will be interpreted as full acceptance of the changes.
11. Applicable Jurisdiction
Disputes arising from the interpretation or execution of these Terms shall be resolved in accordance with the applicable Brazilian legislation, electing the jurisdiction of AGE's headquarters to settle any conflicts, except for legal hypotheses that determine a different jurisdiction.
